Terms of Service

faborapi ("faborapi", "we", "us" or "our") operates a low-cost AI API platform available at faborapi.com. The service is operated from Belgium and these terms are governed by Belgian law and applicable European Union regulations.

By creating an account, generating an API key, or sending a request to any faborapi endpoint, you fully and unreservedly accept these terms. If you do not accept them, do not use the service. If you use faborapi on behalf of a company or organisation, you confirm that you are authorised to bind that entity to these terms.

We may update these terms to reflect changes in the service, our upstream providers, or the law. The "Last updated" date above always reflects the current version, and continued use after an update constitutes acceptance of the revised terms.

faborapi is a technical intermediary platform that provides unified, cost-optimised access to third-party artificial intelligence models, including models from Anthropic, OpenAI, Google and xAI. A single faborapi API key gives you access to the full catalogue through one balance.

faborapi does not design, train, host or control these models. The service acts as a relay: your request body is forwarded to the upstream provider and the response is returned to you. Our API follows widely adopted request and response conventions (commonly described as "OpenAI-compatible"), which is a technical interoperability detail and does not imply any partnership, endorsement or affiliation with any model provider.

The model catalogue, model names, capabilities and prices may change at any time when an upstream provider adds, updates, deprecates or withdraws a model. The live catalogue available through the models endpoint and the documentation is the authoritative reference.

• You must provide a valid email address and confirm it before you can access the service. Accounts created with false, misleading or impersonating information may be suspended.
• Secret keys beginning with sk-fabor- are displayed only once, at creation time. We store only a cryptographic hash, so we cannot recover a lost key — you can revoke it and create a new one at any time.
• You are strictly and exclusively responsible for keeping your keys confidential. Any request made with a valid key is deemed to originate from its holder and will be billed accordingly, including requests resulting from a leaked, shared, committed or stolen key.
• You must notify us without delay at support@faborapi.com if you suspect that a key or your account has been compromised, and revoke the affected key immediately.
• You may not share, resell or sublicense your account credentials, and you may not create multiple accounts to circumvent a suspension or any limit applied to your account.

faborapi works on a strictly prepaid basis. Credits are added to your balance only after a successful payment through one of the available methods (bank cards via Stripe, Manza for Morocco, or Mobile Money via PawaPay). There is no subscription, no invoice on account and no negative balance.

• Usage is billed in real time based on the input and output tokens actually consumed, at the price published for the model at the time of the request. Your remaining balance and per-request history are visible on the Usage page.
• Requests that fail due to a faborapi system error are not billed. Requests rejected by an upstream provider because of your input, your parameters or your content are not billed for completion tokens but may not be retried free of charge indefinitely.
• Once a request has started streaming, the tokens already produced are consumed and billed, even if you close the connection early.
• Credits are personal, non-transferable and have no cash value. Purchased credits are in principle non-refundable.
• Refunds or compensatory credits may nevertheless be granted on a case-by-case basis, at faborapi's sole discretion, where a proven major technical incident attributable to our own infrastructure prevented you from using the service. Requests must be sent to support@faborapi.com with the relevant dates and request details.
• Applicable taxes, payment-provider fees and currency-conversion differences are borne by you. Local-currency amounts shown at checkout are converted using a daily reference rate and rounded up.

The files endpoint lets you upload documents and images and reference them from your messages. The following rules apply:

• Maximum size: 20 MB per file. Files are stored in private storage and are accessible only to the account that uploaded them.
• Retention: files are kept for as long as you want them. They are deleted when you explicitly delete them through the API (DELETE /v1/files/{file_id}) or when your account is closed.
• You retain all intellectual property rights in your files, prompts and outputs. We do not use your content to train models.
• You warrant that you hold all rights and permissions necessary to upload and process the content you send, including any personal data it may contain, and that transmitting it does not infringe third-party rights.
• Content sent to a model is transmitted to the relevant upstream provider for processing and is therefore also subject to that provider's own terms and data-handling practices.
• Where you send personal data belonging to your own users, you act as the controller of that data and are responsible for having a lawful basis for the processing.

You may not use faborapi, directly or indirectly, to:

• Generate, request or distribute unlawful content, including hateful, harassing, defamatory, violent or sexually explicit material involving minors (CSAM), or content that facilitates serious harm to people.
• Create malware, ransomware, phishing material or exploits, conduct denial-of-service attacks, vulnerability scanning, credential stuffing, scraping abuse or spam campaigns.
• Bypass safety filters, jailbreak or attempt to extract model weights or system prompts, or otherwise violate the acceptable use policies of the upstream providers (Anthropic, OpenAI, Google, xAI), whose policies apply to every request you send through faborapi.
• Use the service for fraud, money laundering, or in or for the benefit of a country, territory or person subject to United Nations, European Union, Belgian or United States sanctions or export controls.
• Resell raw access to the service in a way that presents faborapi capacity as your own infrastructure without adding a genuine product of your own, or use automated means to abuse promotional pricing.

faborapi reserves the right to suspend or revoke any key or account in breach of this policy immediately, without prior notice and without compensation, and to report unlawful activity to the competent authorities. Where the breach is manifest and serious, the remaining balance may be forfeited.

The service is provided "as is" and "as available", without warranty of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement.

• We do not guarantee uninterrupted or error-free operation. Outages, latency, rate limits and model deprecations at upstream providers, as well as scheduled or emergency maintenance, may affect availability, and no service-level agreement is granted unless separately agreed in writing.
• We accept no responsibility for the accuracy, truthfulness, completeness, legality or suitability of the outputs generated by the AI models. Outputs may be incorrect or fabricated, and you are responsible for reviewing them before relying on them, in particular in medical, legal, financial or safety-critical contexts.
• You are responsible for your own integration, including retry logic, spend monitoring and the protection of your end users.

Limitation of liability. To the maximum extent permitted by law, faborapi's total aggregate liability arising out of or in connection with the service and these terms, whatever the legal basis of the claim, is expressly limited to fifty United States dollars (USD 50). We are not liable for indirect or consequential damages, including loss of profit, loss of data, loss of opportunity or business interruption. Nothing in these terms excludes liability for fraud, wilful misconduct, death or personal injury, or any other liability that cannot be limited under Belgian law, including the mandatory rights of consumers.

These terms are governed by Belgian law, without prejudice to the mandatory protections available to consumers residing in their own country of residence. Any dispute relating to the validity, interpretation or performance of these terms shall be submitted to the competent courts of Belgium.

Either party may terminate this agreement at any time: you by closing your account, and faborapi by suspending access in accordance with these terms. Provisions relating to billing, acceptable use, disclaimers, limitation of liability and governing law survive termination.
